Article 95 : Programme de la consultation architecturale

ouverte 1 – La consultation architecturale ouverte fait l’objet d’un programme qui indique les besoins auxquels doit répondre le projet et en fixe la consistance prévisionnelle ainsi que le budget maximum prévisionnel prévu pour l’exécution dudit projet. 2 – Le programme de la consultation architecturale ouverte comporte, en outre, les éléments suivants: – l’énoncé de l’objectif recherché par la consultation et l’exposé des aspects importants à considérer ; – une définition détaillée des composantes du projet et de sa consistance ; – une description du contexte d’intervention, accompagnée de l’énoncé des dispositions législatives et réglementaires en matière d’urbanisme relatives au projet. 3 – Il est joint, le cas échéant, à ce programme: – les levés topographiques du site du projet ; – les études géotechniques préliminaires susceptibles de renseigner l’architecte sur le projet envisagé ; – le document attestant l’assainissement de l’assiette foncière ; – le plan côté ; – la note de renseignement délivrée par l’agence urbaine ; – tout autre document, en lien avec le projet, prévu par la loi n° 66–12 relative au contrôle et à la répression des infractions en matière d’urbanisme et de construction. 4 – Le programme doit être signé par le maître d’ouvrage et un architecte de l’administration avant le lancement de la procédure de consultation architecturale. 5 – Le programme prévoit l’allocation de primes aux trois projets les mieux classés parmi les projets retenus et en fixe le montant. La prime octroyée au lauréat titulaire du contrat d’architecte est déduite des honoraires qui lui sont dus au titre dudit contrat.

1 –The open architectural consultation shall be the subject of a programme indicating the needs to be met by the project and setting out its estimated scope and the maximum estimated budget set for its implementation. 2 –The open architectural consultation programme also includes the following elements : –A statement of the objective sought by the consultation and an outline of the important aspects to be taken into account; –A detailed definition of the project's components and consistency. –A description of the context in which the project is being carried out, together with a statement of the town planning laws and regulations applicable to the project. 3 –Where appropriate, this programme shall be accompanied by : –Topographical surveys of the project site ; –Preliminary geotechnical studies likely to provide the architect with information on the planned project; –A document attesting to the sanitation of the land subject to the project; –Dimensional drawings; –The information note issued by the relevant urban agency; –Any other document relating to the project, as provided for by law no. 66-12 on the control and punishment of offences in town planning and construction. 4 –The programme must be signed by the project owner and an architect from the administration before launching the architectural consultation procedure. 5 –The programme provides for the allocation of premiums to the three top-ranked projects among those selected, and sets the amount of these premiums. The premiums awarded to the winner of the architect's contract is deducted from the fees due to him under the said contract.
