Article 82 : Evaluation et classement des projets et

attribution du marché I) Le jury de concours procède, à huis clos, à l’évaluation des projets proposés par les concurrents. Il peut, avant de se prononcer, consulter tout expert ou technicien qui pourrait l’éclairer sur des points particuliers des projets proposés ou instituer une sous–commission pour les analyser. Lorsque le jury de concours décide de consulter un expert et/ou un technicien, le président du jury demande au maître d’ouvrage de convoquer l’expert et/ou le technicien concerné pour participer aux travaux du jury ou de la sous– commission. La sous – com m ission ne p eut être composée exclusivement de membres du jury. Les appréciations des experts, des techniciens ou des membres de la sous–commission doivent être objectives, non–discriminatoires, vérifiables et dûment motivées. Ces appréciations ne doivent pas porter sur l’admissibilité ou non des projets. Les conclusions des experts, des techniciens ou des membres de la sous–commission sont consignées dans des rapports qu’ils établissent et signent sous leur responsabilité. Avant d’émettre son avis, le jury peut saisir, par écrit, les concurrents afin de fournir des éclaircissements sur leurs projets. Il peut, également, demander à un ou plusieurs concurrents d’apporter certaines modifications à leurs projets. Ces modifications peuvent se rapporter à la conception et/ou à l’exécution du projet. Dans ce cas, le concurrent est tenu, le cas échéant, d’indiquer le coût qui découle de ces modifications. Les procédés et les coûts proposés par les concurrents ne peuvent être divulgués aux autres concurrents. Le jury écarte tout projet dont le coût de réalisation excède le budget prévisionnel maximum prévu par le programme de concours pour l’exécution du projet. II) Le jury procède, ensuite, à l’évaluation et au classement des projets sur la base des critères figurant au règlement du concours comme suit: A. Lorsque le concours porte uniquement sur la conception d’un projet : Le jury procède au classement des projets en fonction de la valeur technique et esthétique de chaque projet et de son coût global, et ce conformément aux critères fixés par le règlement du concours ; Le jury écarte les projets qui ne remplissent pas les critères fixés par le règlement du concours et arrête les projets retenus ; Le jury de concours procède à la notation du projet en fonction des critères fixés par le règlement du concours en attribuant une note sur cent (100) à chaque critère ; Le jury procède à la notation de l’estimation du coût du projet proposé, hors taxes, en attribuant une note de cent (100) points à l'estimation la moins-disante et des notes inversement proportionnelles à leurs montants aux autres estimations. En vue de classer les offres et d’arrêter la liste des concurrents à primer, le jury procède à la pondération des notes obtenues par chaque concurrent en fonction du projet proposé et de l’estimation du coût hors taxes dudit projet. La note globale sera obtenue par l’addition de la note technique et de la note de l’estimation du coût hors taxes du projet, après application d’une pondération comme suit: – quatre–vingts pour cent (80%) pour le projet proposé ; – vingt pour cent (20%) pour le coût hors taxes proposé du projet. B. Lorsque le concours porte sur l’un des cas prévus aux alinéas b), c) et d) du paragraphe 1) de l’article 66 du présent décret: 1 – Cas prévus aux alinéas b) et c) de l’article 66 du présent décret: Le jury procède à l’examen et à l’évaluation des projets en fonction de la valeur technique et esthétique de chaque projet, de son coût et, le cas échéant, des conditions de son exécution, et ce conformément aux critères fixés par le règlement du concours. Le jury écarte les projets qui ne remplissent pas les critères fixés par le règlement du concours et arrête les projets retenus. Le jury de concours finalise, le cas échéant, avec les concurrents retenus, les termes du projet de marché à remettre au maître d’ouvrage et négocie les répercussions éventuelles des modifications citées ci–dessus sur le coût du projet. Le jury de concours procède à la notation du projet en fonction des critères fixés par le règlement du concours, en attribuant une note sur cent (100) à chaque critère. Le jury de concours procède à la notation de l’estimation du coût du projet proposé, hors taxes, en attribuant une note de cent (100) points à celle la moins–disante et des notes inversement proportionnelles à leurs montants aux autres estimations. A l’issue de cette évaluation, la séance publique est reprise à la date et à l’heure annoncées par le président du jury, telles qu’elles ont été affichées par le maître d’ouvrage. Le jury de concours procède à l’ouverture des plis comportant les offres financières des concurrents, conformément aux dispositions de l’article 42 du présent décret. Cette formalité accomplie, la séance publique prend fin. Le public et les concurrents se retirent de la salle. Le jury poursuit ses travaux à huis clos. Il écarte les concurrents dont les offres financières : – ne sont pas conformes à l’objet du marché ; – ne sont pas signées ; – sont signées par une personne non habilitée à engager le concurrent concerné au regard de la ou des pièces justifiant les pouvoirs conférés ; – expriment des restrictions ou des réserves ; – présentent des différences dans les libellés des prix, l’unité de compte ou les quantités par rapport aux données prévues dans le descriptif technique, dans le bordereau des prix et le détail estimatif. Le jury vérifie, ensuite, le résultat des opérations arithmétiques des offres financières des concurrents retenus, en tenant compte des rabais éventuels contenus dans ces offres. Il rectifie, le cas échéant, les erreurs de calcul et rétablit les montants exacts des offres concernées. Le jury procède à l’évaluation et à la notation des offres financières, en attribuant une note de cent (100) points à l’offre la moins–disante et des notes inversement proportionnelles à leurs montants aux autres offres. Le jury procède à l’évaluation des offres en vue de choisir l’offre économiquement la plus avantageuse. A cet effet, il procède à la pondération des notes obtenues par chaque concurrent en fonction du projet proposé, de l’estimation du coût hors taxes du projet et de l’offre financière. La note globale sera obtenue par l’addition de la note technique, de la note de l’estimation du coût global du projet, hors taxes, et de la note financière, après l'introduction d’une pondération appliquée comme suit : – soixante-dix pour cent (70%) pour le projet proposé ; – vingt pour cent (20%) pour le coût global proposé du projet, hors taxes ; – dix pour cent (10%) pour l’offre financière. Dans ce cas, le cahier des prescriptions spéciales doit prévoir un seuil de tolérance par rapport à l’estimation du coût global du projet ayant été à la base de l’attribution du marché ainsi que les conséquences pour le concurrent retenu, en cas de dépassement dudit seuil de tolérance. 2 – Cas prévu au d) paragraphe 1) de l’article 66 visé ci-dessus : Après examen et évaluation des projets relatifs au marché de conception-réalisation, le jury procède à la détermination de la note globale de chaque projet par l’addition de la note technique et de la note financière obtenues conformément à l’alinéa 1 du B ci-dessus, après l'introduction d’une pondération appliquée comme suit : – soixante–dix pour cent (70%) pour le projet proposé ; – trente pour cent (30%) pour l’offre financière. III) Le jury procède, ensuite, au classement des projets des concurrents. Le concurrent ayant obtenu la note globale la plus élevée est classé premier. Dans le cas où deux ou plusieurs projets ont obtenu des notes globales équivalentes, le jury retient le concurrent ayant obtenu la meilleure note technique pour le projet proposé. Si ces notes techniques sont également équivalentes, le jury procède au tirage au sort pour classer les concurrents. IV) A l’issue de ce classement, le président du jury de concours invite, par lettre recommandée avec accusé de réception, les concurrents concernés à: a) produire le complément des pièces du dossier administratif prévues au troisième paragraphe du A du II) de l’article 53 du présent décret ; b) confirmer, le cas échéant, les rectifications des erreurs matérielles relevées ; c) régulariser, le cas échéant, les discordances constatées entre les diverses pièces de leurs dossiers. A cet effet, il leur fixe un délai qui ne peut être inférieur à sept jours à compter de la date de réception de la lettre d’invitation. Le président du jury suspend la séance d’évaluation et de classement des projets et fixe la date et l’heure de reprise des travaux de la séance. Les éléments de réponse des concurrents sont produits dans un pli fermé qui comporte, de façon apparente, les mentions suivantes: – le nom et l’adresse du concurrent ; – l’objet du concours ; – l’avertissement que « le pli ne doit être ouvert que par le président du jury » et porter la mention apparente « complément de dossier et éléments de réponse ». Ce pli doit être soit déposé, contre récépissé, dans le bureau du maître d’ouvrage indiqué dans la lettre d’invitation, soit envoyé, par lettre recommandée avec accusé de réception ou par voie électronique conformément aux dispositions de l’article 135 du présent décret. Le dépôt de ce pli est inscrit au registre spécial prévu à l’article 4 du présent décret. Le jury se réunit au lieu, au jour et à l’heure fixés pour la reprise de la séance, s’assure de l’existence du support ayant servi de moyen d’invitation des concurrents concernés et procède à la vérification des réponses et des pièces reçues. Après examen des pièces et des réponses reçues, le jury: 1 – écarte tout concurrent qui: – ne répond pas dans le délai imparti ; – ne produit pas les pièces exigées ou produit des pièces non conformes ; – ne régularise pas les discordances relevées ; – ne confirme pas les rectifications des erreurs matérielles demandées. 2 – arrête, ensuite, la liste définitive des concurrents qui satisfont les conditions requises au a), b) et c) du IV ci–dessus ; 3 – propose au maître d’ouvrage de retenir le projet classé le premier et d’attribuer une prime aux cinq candidats les mieux classés. Les primes ne sont pas octroyées aux concurrents écartés conformément aux dispositions du 1) ci–dessus. Le classement proposé par le jury ne peut, en aucun cas, être modifié.
Official English translation

I) the competition jury shall evaluate the projects proposed by the competitors behind closed doors. Before making its decision, the jury may consult any expert or technician in order to enlighten it on particular points of the proposed projects or set up a sub-commission to analyse them. When the competition jury decides to consult an expert or a technician, the president of the jury asks the project owner to convene the expert and/or technician concerned to take part in the work of the jury or sub-commission. The sub-commission may not be composed exclusively of members of the jury. The assessments made by the experts, technicians or members of the sub-commission must be objective, non-discriminatory, verifiable and duly motivated. These assessments must not concern the admissibility or otherwise of the projects. The conclusions of the experts, technicians or members of the sub-commission are recorded in reports which they draw up and sign under their own responsibility. Decree on public procurement-No. 2-22-431-8 March 2023 75 Before issuing its opinion, the jury may contact the competitors in writing in order to provide clarification on their projects. It may also ask one or more competitors to make some changes to their projects. These modifications may relate to the design and/or implementation of the project. In this case, the competitor shall, where applicable, be required to indicate the cost resulting from these modifications. The processes and costs proposed by competitors may not be disclosed to other competitors. The jury rejects any project whose completion cost exceeds the maximum estimated budget set out in the competition programme, for the execution of the project. II) The jury then evaluates and ranks the projects on the basis of the criteria set out in the competition rules, as follows: A. Where the competition is concerned solely with the design of a project, The jury shall rank the projects on the basis of the technical and aesthetic value of each project and its overall cost, in accordance with the criteria set out in the competition rules; The jury rejects projects that do not meet the criteria set out in the competition rules and decides which projects are to be selected. The competition jury rates the project according to the criteria set out in the competition rules, assigning a score out of one hundred (100) to each criterion ; the jury rates the estimated cost of the proposed project, excluding taxes, by assigning a score out of one hundred (100) points to the lowest estimate and marks inversely proportional to the amounts of the other estimates. In order to rank the bids and draw up the list of competitors to be awarded prizes, the jury will weight the scores obtained by each competitor according to the proposed project and the estimated cost of the project excluding taxes. The overall score will be obtained by adding together the technical score and the score for the estimated cost excluding taxes of the project, after applying a weighting as follows: –Eighty per cent (80%) for the proposed project ; –Twenty percent (20%) for the proposed cost excluding taxes of the project. B. When the competition concerns one of the cases provided for in sub-paragraphs b), c) and d) of paragraph 1) of article 66 of this decree: 1 –Cases provided for in subparagraphs b) and c) of article 66 of this decree : The jury shall examine and evaluate the projects on the basis of the technical and aesthetic value of each project, its cost and, where applicable, the conditions of its execution, in accordance with the criteria set out in the competition rules. The jury rejects projects that do not meet the criteria set out in the competition rules and decides which projects are to be selected. If necessary, the competition jury will finalise with the selected competitors the terms of the draft contract to be submitted to the project owner and negotiate the possible repercussions of the above changes on the cost of the project. The competition jury rates the project according to the criteria set out in the competition rules, assigning a score out of one hundred (100) to each criterion. Decree on public procurement-No. 2-22-431-8 March 2023 76 The competition jury rates the estimated cost of the proposed project, excluding taxes, by assigning a score out of one hundred (100) points to the lowest estimate and marks inversely proportional to the amounts of the other estimates. At the end of this evaluation, the public session shall be resumed on the date and at the time announced by the president of the jury, as posted by the project owner. The competition jury opens the envelopes containing the competitors' financial bids, in accordance with the provisions of article 42 of this decree. Once this formality has been completed, the public session is closed. The public and the competitors leave the room. The jury continues its work behind closed doors. It excludes competitors whose financial offers: –Do not comply with the subject of the contract ; –Are not signed; –Are signed by a person not authorised to bind the competitor concerned with regard to the document or documents justifying the powers conferred; –Express restrictions or reservations; –Present differences in the price wording, the unit of account or the quantities compared to the data provided in the technical description, in the price schedule and the itemised estimate. The jury then verifies the arithmetic operations of the financial bids submitted by the selected competitors, taking into account any discounts granted in these bids. Where necessary, it corrects any calculation errors and re-establishes the exact amounts of the bids concerned. The jury evaluates and rates the financial bids, assigning a score out of one hundred (100) points to the lowest bid and marks inversely proportional to the amounts of the other bids. The jury evaluates the bids in order to select the most economically advantageous bid. To this end, it weights the scores obtained by each competitor according to the project proposed, the estimated cost of the project excluding taxes and the financial offer. The overall score will be obtained by adding together the technical score, the score for the estimated overall cost of the project, excluding taxes, and the financial score, after applying a weighting as follows: – Seventy percent (70%) for the proposed project ; – Twenty per cent (20%) for the proposed overall cost of the project, excluding taxes; – Ten percent (10%) for the financial offer. In this case, the special specifications book must stipulate a tolerance threshold in relation to the estimated overall cost of the project on the basis of which the contract is awarded, as well as the consequences for the successful competitor if the said tolerance threshold is exceeded. 2 –Case provided for in d) paragraph 1) of article 66 referred to above : After examining and evaluating the projects concerning the design-build contract, the jury determines the overall score for each project by adding together the technical score and the financial score obtained in accordance with subparagraph 1 of B above, after applying a weighting as follows: –Seventy percent (70%) for the proposed project; Decree on public procurement-No. 2-22-431-8 March 2023 77 –Thirty percent (30%) for the financial offer. III) The jury then ranks the competitors' projects. The competitor with the highest overall score is ranked first. If two or more projects have obtained equivalent overall scores, the jury shall select the competitor with the best technical score for the proposed project. If these technical scores are also equivalent, the jury will draw lots to rank the competitors. IV) Following this ranking, the president of the competition jury invites, by registered letter with acknowledgement of receipt, the competitors concerned to : a) Produce the additional documents of the administrative file provided for in the third paragraph of A of II) of article 53 of this decree ; b) Confirm, where applicable, the rectification of any material errors found; c) Rectify, if necessary, discrepancies between the various documents of their files. To this end, the jury sets a deadline of at least seven days from the date of receipt of the letter of invitation. The president of the jury suspends the project evaluation and ranking session and sets the date and time for resuming the session. Competitors' responses shall be submitted in a sealed envelope, which shall clearly include the following information: –the name and address of the competitor; –the subject of the competition; –the warning that « the envelope must only be opened by the president of the jury» and clearly marked « supplementary information to the file and response elements ». This envelope must either be lodged, against receipt, at the project owner's office indicated in the letter of invitation, or sent by registered letter with acknowledgement of receipt or by electronic means in accordance with the provisions of article 135 of this decree. The deposit of this envelope is recorded in the special register provided for in article 4 of this decree. The jury meets at the place, on the day and at the time set for the resumption of the session, checks the existence of the medium used to invite the competitors concerned and verifies the responses and documents received. After examining the documents and answers received, the jury : 1 –Excludes any competitor who: –Fails to reply within the given time limit; –Does not produce the required documents or produces non-conforming documents; –Fails to rectify any discrepancies noted ; –Does not confirm the rectification of material errors requested. 2 –Then draws up the final list of competitors who satisfy the conditions laid down in a), b) and c) of IV above; 3 –Proposes to the project owner that it select the project ranked first and award a prize to the five top ranked candidates. Decree on public procurement-No. 2-22-431-8 March 2023 78 Prizes are not awarded to competitors excluded in accordance with the provisions of 1) above. The ranking proposed by the jury may not be changed under any circumstances.
