Décret n° 2-22-431 du 15 chaabane 1444 (8 mars 2023) relatif aux marchés publics

Article 66 : Principes et modalités du concours

1 – Le concours porte: a) soit sur la conception d’un projet ; b) soit à la fois sur la conception d’un projet et la réalisation de l’étude y afférente ; c) soit à la fois sur la conception d’un projet, la réalisation de l’étude y afférente et le suivi et le contrôle de sa réalisation ; d) soit sur la conception et la réalisation du projet, lorsqu’il s’agit d’un marché de conception-réalisation tel que prévu à l’article 11 du présent décret. Les prestations qui peuvent faire l’objet de concours concernent, notamment, les domaines de l’aménagement du territoire national, de l’urbanisme ou de l’ingénierie ainsi que les prestations objet de marchés de conception– réalisation. 2 – Le concours est organisé sur la base d’un programme établi par le maître d’ouvrage. 3 – Le concours comporte un appel public à la concurrence. Les concurrents désirant y participer peuvent déposer une demande d’admission. Seuls sont admis à déposer des projets, les concurrents retenus par le jury du concours à l’issue de la séance d’admission conformément aux dispositions de l’article 74 du présent décret. 4 – Les projets proposés par les concurrents retenus sont examinés et classés par un jury. 5 – L’ouverture des plis s’effectue en séance publique.

1 –The competition covers either: Decree on public procurement-No. 2-22-431-8 March 2023 68 a) The design of a project; b) Both the design of a project and the conduct of the related study; c) The design of a project, the conduct of the related study and the monitoring and control of its completion; d) The design and implementation of the project, in the case of a design-build contract as provided for in article 11 of this decree. The services that may be the subject of a competition relate, in particular, to the fields of national land-use planning, urban planning or engineering, as well as services that are the subject of design-build contracts. 2 –The competition is organised on the basis of a programme drawn up by the project owner. 3 –The competition includes a public call for competition. Competitors wishing to take part may submit an application for admission. Only those competitors selected by the competition jury at the end of the admission session in accordance with the provisions of article 74 of this decree may submit projects. 4 –The projects proposed by the selected competitors are examined and ranked by a jury. 5 –The opening of bids takes place in a public session.
