Article 32 : Présentation des dossiers des concurrents

1 – Le dossier à présenter par chaque concurrent est mis dans un pli fermé portant les mentions suivantes : – le nom et l’adresse du concurrent ; – l’objet du marché et, le cas échéant, l’indication du ou des lots en cas de marché alloti ; – la date et l’heure de la séance d’ouverture des plis ; – l’avertissement que « le pli ne doit être ouvert que par le président de la commission d’appel d’offres lors de la séance publique d’ouverture des plis ». 2 – Ce pli contient deux enveloppes distinctes, lorsque l’offre technique n’est pas exigée ou trois enveloppes distinctes, lorsque la présentation d’une offre technique, incluant ou non une offre variante, est exigée : a) la première enveloppe contient, outre les pièces des dossiers administratif et technique, le cahier des prescriptions spéciales et le règlement de consultation paraphés et signés et portant la mention « lu et accepté » par le concurrent ou son représentant dûment habilité. Cette enveloppe doit être fermée et porter de façon apparente la mention « dossiers administratif et technique » ; b) la deuxième enveloppe contient l’offre financière. Elle doit être fermée et porter de façon apparente la mention « offre financière » ; c) la troisième enveloppe contient l’offre technique. Elle doit être fermée et porter de façon apparente la mention « offre technique », qu’elle inclut ou non une offre variante. 3 – Les trois enveloppes visées ci–dessus indiquent de manière apparente : – le nom et l’adresse du concurrent ; – l’objet du marché et, le cas échéant, l’indication du ou des lots concernés ; – la date et l’heure de la séance d’ouverture des plis. 4 – Outre le pli prévu au premier paragraphe ci–dessus, le concurrent est tenu de présenter, le cas échéant, un pli distinct contenant les prospectus, notices ou autres documents techniques.

1 –The file to be submitted by each competitor shall be placed in a sealed envelope bearing the following information : –the name and address of the competitor; Decree on public procurement-No. 2-22-431-8 March 2023 39 –the subject of the contract and, where applicable, an indication of the lot or lots in the case of an allotment contract; –the date and time of the bid opening session; –the warning that « the envelope must only be opened by the president of the tendering Commission at the public bid opening session ». 2 – This envelope contains two separate envelopes, when the technical offer is not required, or three separate envelopes, when the submission of a technical offer, with or without a variant offer, is required: a) the first envelope contains, in addition to the documents in the administrative and technical files, the special specifications book and the consultation regulations initialled and signed and marked « read and accepted» by the competitor or his duly authorised representative. This envelope must be sealed and clearly marked « administrative and technical files»; b) The second envelope contains the financial offer. This envelope must be closed and clearly marked « financial offer »; c) The third envelope contains the technical offer. It must be closed and clearly marked « technical offer », whether or not it includes a variant offer. 3 –The three envelopes referred to above shall clearly specify : – The name and address of the competitor; –the subject of the contract and, where applicable, an indication of the lot or lots concerned; –the date and time of the bid opening session. 4 –In addition to the envelope provided for in the first paragraph above, the competitor is required to submit, where applicable, a separate envelope containing the prospectuses, notices or other technical documents.
