Décret n° 2-22-431 du 15 chaabane 1444 (8 mars 2023) relatif aux marchés publics

Article 29 : Déclaration sur l’honneur

La déclaration sur l’honneur indique les mentions suivantes : 1 – lorsqu’il s’agit d’une personne physique, le nom, le prénom, le domicile, les numéros de téléphone et de fax et l’adresse électronique du concurrent ; 2 – lorsqu’il s’agit d’une société, la dénomination ou la raison sociale de la société, sa forme juridique, son capital social, l’adresse de son siège social, le nom, le prénom, la qualité en laquelle son représentant agit et les pouvoirs qui lui sont conférés et les numéros de téléphone et de fax et l’adresse électronique de la société ; 3 – lorsqu’il s’agit d’une coopérative ou d’une union de coopératives, la dénomination de la coopérative ou de l’union de coopératives, son capital, son siège, le nom, le prénom et la qualité en laquelle le représentant du concurrent agit et les pouvoirs qui lui sont conférés, les numéros de téléphone et de fax et l’adresse électronique de la coopérative ou de l’union de coopératives ; 4 – le numéro d’immatriculation au registre de commerce pour les concurrents soumis à l’obligation d’immatriculation au registre de commerce, le numéro d’immatriculation au registre local des coopératives ou le numéro d’inscription au registre national de l’auto–entrepreneur, selon le cas ; 5 – le numéro d’inscription à la taxe professionnelle, le numéro d’affiliation à la Caisse nationale de sécurité sociale ou à tout autre régime particulier de prévoyance sociale pour les concurrents installés au Maroc et le relevé d’identité bancaire. La déclaration sur l’honneur mentionne également que le concurrent : a) s’engage à couvrir, dans les conditions fixées aux cahiers des charges, par une police d’assurance, les risques découlant de son activité professionnelle ; b) s’engage, s’il envisage de recourir à la sous–traitance, à veiller à ce que celle–ci ne dépasse pas cinquante pour cent (50%) du montant du marché et qu’elle ne porte pas sur le lot ou le corps d’état principal du marché, et à s’assurer que les sous–traitants auxquels il recourt remplissent les conditions prévues à l’article 27 du présent décret ; c) atteste qu’il dispose des autorisations requises pour l’exécution des prestations telles que prévues par la législation et la réglementation en vigueur ; d) atteste qu’il n’est pas en liquidation judiciaire ou en redressement judiciaire, et s’il est en redressement judiciaire, qu’il est autorisé par l’autorité judiciaire compétente à participer aux appels d’offres ; e) s’engage à ne pas recourir par lui–même ou par personne interposée à des pratiques de fraude ou de corruption des personnes qui interviennent, à quelque titre que ce soit, dans les procédures de passation, de gestion et d’exécution du marché ; f) s’engage à ne pas faire, par lui–même ou par personne interposée, de promesses, de dons ou de présents, en vue d’influer sur la procédure de conclusion du marché et de son exécution ; g) atteste qu’il n’est pas en situation de conflit d’intérêts ; h) atteste qu’il n’a pas participé à la préparation du dossier de l’appel d’offres considéré ; i) certifie l’exactitude des renseignements contenus dans la déclaration sur l’honneur et dans les pièces fournies dans son dossier de candidature, sous peine de l’application des mesures coercitives prévues à l’article 152 du présent décret. La déclaration sur l’honneur doit être signée par le concurrent.

Official English translation

The declaration of honor shall include the following information: 1 –In the case of a natural person, the last name, first name, address, phone and fax numbers and the competitor's  e-mail address ; 2 –In the case of a company, the company name or corporate name, its legal form, its share capital, the address of its registered office, the last name, first name, capacity in which the representative of the competitor is acting and the powers conferred on him and the company's phone and fax numbers and e-mail address; 3 –In the case of a cooperative or a union of cooperatives, the name of the cooperative or the union of cooperatives, its capital, its registered office, the last name, first name and the capacity in which the representative of the competitor is acting and the powers conferred on him, the phone and fax numbers and the e-mail address of the cooperative or the union of cooperatives; Decree on public procurement-No. 2-22-431-8 March 2023 36 4 –The registration number in the trade register for competitors subject to compulsory registration in the trade register, the registration number in the local register of cooperatives or the registration number in the national register of self-employed entrepreneurs, as appropriate; 5 –Professional tax registration number, affiliation number with the National Social Security Fund or any other special social security scheme for competitors based in Morocco, and bank identity statement. The declaration of honor shall also state that the competitor: a) Undertakes to cover, under the conditions laid down in the specifications book, by an insurance policy, the risks arising from his professional activity; b) undertakes, if he intends to subcontract, to ensure that subcontracting does not exceed fifty percent (50%) of the contract amount and that it does not concern the lot or the main body of the contract, and to ensure that the subcontractors he uses meet the conditions laid down in Article 27 of this Decree; c) Certifies that he has the authorisations required for the performance of the services as provided for by the laws and regulations in force ; d) Certifies that he is not in judicial liquidation or judicial recovery, and if he is in judicial recovery, that he is authorised by the competent judicial authority to participate in calls for tenders; e) Undertakes not to use, either personally or through an intermediary, fraud practices or corruption of persons involved in any capacity whatsoever in the procedures for awarding, managing and performing the contract; f) Undertakes not to make, either personally or through an intermediary, any promises, donations or gifts in order to influence the procedure for concluding the contract and its performance ; g) Certifies that he is not in a situation of conflict of interest; h) Certifies that he has not participated in the preparation of the tender documents in question ; i) Certifies the accuracy of the information contained in the declaration of honor and in the documents provided in his application file, failing which the coercive measures provided for in article 152 of this decree will be applied. The declaration of honor must be signed by the competitor.
