Décret n° 2-22-431 du 15 chaabane 1444 (8 mars 2023) relatif aux marchés publics

Article 160 : Secret professionnel

Sous peine de l’application des sanctions prévues par la législation en vigueur, tout intervenant dans la procédure de passation des marchés publics est astreint au secret professionnel en ce qui concerne les données et les informations dont il a eu connaissance à l’occasion de l’exercice de ses fonctions.

Official English translation

subject to the application of the sanctions provided for by the legislation in force, all participants in the public procurement procedure shall be bound by professional secrecy with regard to data and information of which they have become aware during the performance of their duties.
