Décret n° 2-22-431 du 15 chaabane 1444 (8 mars 2023) relatif aux marchés publics

Article 157 : Rapport d’achèvement de l’exécution du

marché Tout marché dont le montant est égal ou supérieur à un million (1.000.000) de dirhams, toutes taxes comprises, doit, dans un délai maximum de trois mois après la réception définitive des prestations, faire l’objet d’un rapport d’achèvement établi par le maître d’ouvrage. Ce rapport mentionne notamment: – l’objet du marché ; – les parties contractantes ; – la nature des prestations sous–traitées et l’identité ou la dénomination du ou des sous–traitants, le cas échéant ; – le délai d’exécution, en précisant les dates de commencement et d’achèvement de l’exécution des prestations et en justifiant les dépassements éventuels par rapport à la date, initialement, prévue pour l’achèvement de l’exécution des prestations ; – le lieu où les lieux d’exécution des prestations ; – le bilan physique faisant ressortir les changements apportés au programme initial, les variations dans la masse et la nature des prestations ; – le bilan financier faisant ressortir le budget réellement consacré à l’exécution du marché, y compris, le cas échéant, toutes les dépenses subséquentes relatives, notamment, à la révision des prix, aux primes, aux indemnités et aux intérêts moratoires ; – l’appréciation de la réalisation des objectifs assignés au projet ou à la prestation objet du marché et de l’atteinte des indicateurs y relatifs ; – les écarts constatés entre les objectifs initialement prévus et le bilan des réalisations et leur justification. Le rapport d’achèvement est adressé, selon le cas, au ministre concerné ou au président de l’organe délibérant de l’établissement public ou de la personne morale de droit public visée à l’article 2 du présent décret et est versé dans le dossier du marché pour être mis à la disposition des organes compétents aux fins de contrôle et audit visés à l’article 159 du présent décret. En ce qui concerne les collectivités territoriales, ce rapport est communiqué par le maître d’ouvrage à l’autorité compétente et au ministre de l’intérieur à sa demande.
Official English translation

Any contract, the amount of which, is equal to or greater than one million (1,000,000) dirhams, all taxes included, must, within a maximum period of three months after final acceptance of the services, be the subject of a completion report drawn up by the project owner. This report shall mention in particular: –the subject of the contract; –the contracting parties; –the nature of the subcontracted services and the identity or name of the subcontractor or subcontractors, where applicable; –the execution time, specifying the start and completion dates for the performance of the services and justifying any delays in relation to the date initially scheduled for the completion of the performance of the services; –the place or places where the services are to be performed; –A physical assessment showing the changes made to the initial programme and variations in the volume and nature of the services; –the financial statement showing the budget actually devoted to the execution of the contract, including, where applicable, all subsequent expenses relating, in particular, to price adjustments, bonuses, compensation and default interest ; –An assessment of whether the objectives set for the project or service covered by the contract have been achieved and whether the related indicators have been met; – Any discrepancies between the objectives initially set, the record of achievements and the reasons for these discrepancies. The completion report is sent, as the case may be, to the minister concerned or to the president of the legislative body of the public institution or the legal entity governed by public law referred to in Article 2 of this decree and is placed in the contract file to be made available to the competent bodies for the purposes of control and audit referred to in Article 159 of this decree. With regard to local authorities, this report shall be sent by the project owner to the competent authority and to the Minister of the Interior at his request.
