Décret n° 2-22-431 du 15 chaabane 1444 (8 mars 2023) relatif aux marchés publics

Article 156 : Rapport de présentation du marché

Tout projet de marché doit faire l’objet d’un rapport de présentation établi par le maître d’ouvrage qui fait ressortir notamment: – les objectifs assignés au projet ou à la prestation objet du marché et les indicateurs y afférents ; – les moyens à mettre en œuvre pour la réalisation du projet ou de la prestation objet du marché ; – le budget alloué au marché ; – les délais prévus pour la réalisation du projet ou de la prestation ; – la nature et l’étendue des besoins à satisfaire tels que définis par l’article 5 du présent décret ; – l’exposé de l’économie générale du marché ; – les motifs ayant déterminé le choix du mode de passation ; – la justification du choix des critères de sélection des candidatures et de jugement des offres ; – la justification du choix de l’attributaire. En ce qui concerne les marchés négociés, le rapport visé ci–dessus mentionne, dans la mesure du possible, les justifications des prix proposés par rapport aux prix normalement pratiqués sur le marché. Ce rapport, signé par le maître d’ouvrage, doit être versé au dossier du marché pour être mis à la disposition des organes compétents aux fins de contrôle et audit visés à l’article 159 du présent décret. Pour les marchés passés par les collectivités territoriales, le rapport de présentation est communiqué par le maître d’ouvrage au ministre chargé de l’intérieur à sa demande.

All draft contracts must be the subject of a presentation report drawn up by the project owner, setting out in particular : –the objectives assigned to the project or service covered by the contract and the related indicators ; –the means to be used to carry out the project or service covered by the contract; –the budget allocated to the contract; –the deadlines for the completion of the project or service; –the nature and extent of the needs to be met as defined in Article 5 of this Decree; –presentation of the general economy of the contract; Decree on public procurement-No. 2-22-431-8 March 2023 132 –the reasons for the choice of this award method; – Justification for the choice of criteria for selecting applications and assessing tenders; –Justification for the choice of the successful tenderer. As for negotiated contracts, the report referred to above shall mention, as far as possible, the justifications for the prices proposed in relation to the prices normally practiced on the market. This report, signed by the project owner, must be placed in the contract file to be made available to the competent bodies for the purposes of control and audit referred to in article 159 of this decree. For contracts awarded by local authorities, the presentation report shall be sent by the project owner to the Minister of the Interior at his request.
