Décret n° 2-22-431 du 15 chaabane 1444 (8 mars 2023) relatif aux marchés publics

Article 142 : Principes et modalités

Les marchés passés par l’Etat et les collectivités territoriales ne sont valables et définitifs qu’après leur approbation par l’autorité compétente. Les marchés passés par les établissements publics ne sont valables et définitifs qu’après leur approbation par l’autorité compétente et leur visa par le contrôleur d’Etat lorsque ce visa est requis. Les marchés passés par les autres personnes morales de droit public visés à l’article 2 du présent décret ne sont valables et définitifs qu’après leur approbation par l’autorité compétente. L’approbation des marchés doit intervenir avant tout commencement de leur exécution, à l’exception du cas prévu au b) de l’article 90 du présent décret. L’approbation des marchés ne doit être apposée par l’autorité compétente qu’après l’expiration d’un délai d’attente d’une durée de quinze jours à compter du jour suivant la date d’achèvement des travaux de la commission d’ouverture des plis ou la date de signature du marché par l’attributaire lorsque ce marché est un marché négocié.
Official English translation

Contracts awarded by the State and local authorities shall not be valid and final until they have been approved by the competent authority. Contracts awarded by public institutions shall not be valid and final until they have been approved by the competent authority and endorsed by the State Controller where such endorsement is required. Contracts awarded by legal entities governed by public law referred to in article 2 of this decree shall not be valid and final until they have been approved by the competent authority. Contracts must be approved before any start of their performance, with the exception of the case provided for in b) of article 90 of this decree. Approval of the contracts must not be affixed by the competent authority until after the expiry of a waiting period of fifteen days from the day following the date of completion of the work of the bid opening commission or the date of signature of the contract by the successful tenderer when the contract is a negotiated contract.
