Article 111 : Consultation architecturale infructueuse

Le jury déclare la consultation architecturale infructueuse dans l’un des cas suivants : a) si aucune offre n’a été présentée ou déposée ; b) si aucun architecte concurrent n’a été retenu à l’issue de l’examen des dossiers administratifs ; c) si aucun architecte concurrent n’a été retenu à l’issue de l’examen des propositions techniques et financières. La déclaration de la consultation architecturale infructueuse pour le motif visé au a) ci–dessus ne peut justifier le recours à la consultation architecturale négociée que dans le cas où cette consultation a été déclarée infructueuse pour la deuxième fois pour le même motif.

Official English translation

The jury declares the architectural consultation unsuccessful in one of the following cases: a) If no tender has been submitted or lodged ; b) If no competing architect has been selected after examination of the administrative files; c) If no competing architect has been selected after examination of the technical and financial proposals. The declaration of the architectural consultation as being unsuccessful for the reason set out in a) above may only justify recourse to the negotiated architectural consultation if this consultation has been declared unsuccessful after having been issued a second time for the same reason.
