Décret n° 2-22-431 du 15 chaabane 1444 (8 mars 2023) relatif aux marchés publics

Article 10 : Marchés allotis

1 – Les travaux, fournitures ou services peuvent faire l’objet d’un marché unique ou d’un marché alloti. Le maître d’ouvrage choisit entre ces deux modalités de réalisation des prestations en fonction des avantages financiers ou techniques qu’elles procurent ou lorsque l’allotissement est de nature à encourager la participation des très petites, petites et moyennes entreprises, des coopératives, des unions de coopératives et des auto-entrepreneurs. Le maître d’ouvrage peut, le cas échéant, limiter le nombre de lots pouvant être attribués à un même concurrent pour des raisons liées : –– à la sécurité de l’approvisionnement ; –– à la capacité du prestataire à réaliser le marché compte tenu de son plan de charge ; –– au délai d’exécution ; –– au lieu d’exécution ou de livraison. Dans le cas où plusieurs lots sont attribués à un même concurrent, il peut être passé avec ce concurrent un seul marché regroupant l’ensemble de ces lots. Le règlement de consultation prévu à l'article 21 du présent décret doit comporter à cet égard toutes précisions utiles. 2 – Pour l’attribution des lots, le maître d’ouvrage procède : –– soit à l’ouverture, à l’examen des offres de chaque lot et à l’attribution des lots, lot par lot, dans l’ordre de leur énumération dans le dossier d’appel d’offres ; –– soit à l’ouverture, à l’examen de l’ensemble des offres et à l’attribution des lots sur la base de la meilleure combinaison des offres permettant au maître d’ouvrage de retenir l’offre globale la plus avantageuse pour l’ensemble des lots. A cet effet, le règlement de consultation précise le mode retenu d’attribution des lots. Les offres de remise sur le prix présentées par les concurrents en fonction du nombre de lots susceptibles de leur être attribués sont prises en considération. 3 – Au sens du présent article, on entend par lot : –– en ce qui concerne les fournitures : un article, un ensemble d’articles, d’objets ou de marchandises de même nature et présentant un caractère homogène, semblable ou complémentaire ; –– en ce qui concerne les travaux : partie de la prestation à réaliser ou un corps d’état ou un groupe de prestations appartenant à un ensemble plus ou moins homogène et présentant des spécifications techniques semblables ou complémentaires ; –– en ce qui concerne les services : partie de la prestation à réaliser ou groupe de prestations appartenant à un ensemble plus ou moins homogène et présentant des spécif ications tech niques semblables ou complémentaires.

1 –Works, supplies or services may be the subject of a single contract or an allotment contract. The project owner chooses between these two methods for carrying out the services on the basis of the financial or technical advantages they offer or when the allotment is likely to encourage the participation of very small, small and medium-sized enterprises, cooperatives, cooperative unions and self-employed entrepreneurs. The project owner may, if necessary, limit the number of lots that can be awarded to the same competitor for reasons linked to: –Security of supply ; –The capacity of the service provider to perform the contract, taking into account its workload  ; –The time required for performance ; –The place of performance or delivery. If several lots are awarded to the same competitor, a single contract covering all of these lots may be awarded to this competitor. The consultation regulations provided for in article 21 of this decree must contain all relevant details in this respect. 2 –To award the lots, the project owner proceeds as follows: –Either opens and examines the bids for each lot and awards the lots, lot by lot, in the order in which they are listed in the tender documents; –Or opens and examines all the bids and awards the lots on the basis of the best combination of bids, enabling the project owner to select the most advantageous overall bid for all the lots. To this end, the consultation regulations specify the method used to award the lots. Competitors' offers of price discounts based on the number of lots they are likely to be awarded will be taken into consideration. 3 –For the purposes of this article, "lot" means : –With regard to supplies: an article, a set of articles, objects or goods of the same kind and of a homogeneous, similar or complementary nature; –With regard to works: part of the work to be carried out or a body of work or a group of works belonging to a more or less homogeneous set and presenting similar or complementary technical specifications; Decree on public procurement-No. 2-22-431-8 March 2023 12 –With regard to services: part of the service to be provided or a group of services belonging to a more or less homogeneous set and presenting similar or complementary technical specifications.
