Article 90 : Formes des marchés négociés

Les marchés négociés sont conclus: a) soit sur la base de l’acte d’engagement et du cahier des prescriptions spéciales ; b) soit, à titre exceptionnel, par échange de lettres ou par convention spéciale, pour les prestations revêtant un caractère urgent prévues au paragraphe 7 du II) de l’article 89 du présent décret et dont la réalisation est incompatible avec la préparation des documents constitutifs du marché. Les lettres échangées ou la convention spéciale doivent prévoir, au moins, la nature des prestations, la limite des engagements des deux parties en termes de montant et de durée. Ces lettres ou cette convention prévoient également le prix définitif ou provisoire. Les lettres échangées ou la convention spéciale doivent être régularisées sous forme de marché à prix définitif dans les trois mois qui suivent. Section IV. – Prestations sur bons de commande

Negotiated contracts are concluded : a) Either on the basis of the act of commitment and the special specifications book; b) Or, exceptionally, by exchange of letters or by special agreement, for services of an urgent nature provided for in paragraph 7 of II) of article 89 of this decree and the performance of which is incompatible with the preparation of the contract documents. The exchanged letters or the special agreement must, at least, stipulate the nature of the services and the limits of the commitments made by both parties in terms of amount and duration. The letters or agreement must also specify the final or provisional price. The exchanged letters or the special agreement must be regularised in the form of a final price contract within the following three months. Section IV. –Services on purchase orders
