Décret n° 2-22-431 du 15 chaabane 1444 (8 mars 2023) relatif aux marchés publics

Article 87 : Principes

1 – La procédure négociée est un mode de passation des marchés en vertu duquel une commission de négociation choisit l’attributaire du marché après consultation, selon le cas, d’un ou de plusieurs concurrents et négociation des conditions du marché. Ces négociations portent, notamment, sur le prix, le délai d’exécution, la date d’achèvement ou de livraison et les conditions d’exécution ou de livraison de la prestation. Elles ne peuvent, en aucun cas, porter sur l’objet et la consistance du marché. 2 – La commission de négociation se compose du président, de son suppléant et de deux représentants de l’organisme dont relève le maître d’ouvrage, désignés par ce dernier. La commission peut faire appel à toute autre personne, expert ou technicien dont elle juge utile la participation à ses travaux. Lorsque la commission de négociation décide de consulter un expert et/ou un technicien, le président de la commission demande au maître d’ouvrage de convoquer l’expert et/ou le technicien concerné pour participer aux travaux de la commission. 3 – Les marchés négociés sont passés avec publicité préalable et mise en concurrence ou sans publicité préalable et sans mise en concurrence. Les marchés négociés avec publicité préalable et mise en concurrence sont passés conformément aux dispositions de l’article 88 du présent décret. A l’exception des cas prévus aux alinéas 7 et 9 du paragraphe II) de l’article 89 ci-dessous, les marchés négociés sans publicité préalable et sans mise en concurrence sont passés à la suite d’une négociation des conditions du marché par la commission de négociation avec le ou les concurrents consultés. Les négociations font l’objet du rapport visé au paragraphe 9 de l’article 88 ci-dessous. 4 – Tout candidat à un marché négocié doit fournir, au début de la procédure, un dossier administratif et un dossier technique constitués de l’ensemble des pièces prévues à l’article 28 du présent décret. 5 – A l’exception du cas visé à l’alinéa 2 du paragraphe II) de l’article 89 ci–dessous, la passation d’un marché négocié donne lieu à l’établissement, par le maître d’ouvrage, d’un certificat administratif visant le chef d’exception qui justifie le recours à la procédure négociée et explicitant, notamment, les raisons du choix de cette procédure. 6 – L’autorité compétente peut, par décision motivée, mettre fin, à tout moment, à la procédure négociée. La décision d’annulation de la procédure négociée sans publicité préalable et sans mise en concurrence est versée au dossier du marché. La décision d’annulation de la procédure négociée avec publicité préalable et mise en concurrence est publiée sur le portail des marchés publics et versée au dossier du marché.

Principles 1 –The negotiated procedure is a method of awarding contracts whereby a negotiation commission selects the successful tenderer after consulting one or more competitors, as the case may be, and negotiating the terms of the contract. These negotiations especially concern the price, the period of performance, the date of completion or delivery and the conditions of performance or delivery of the service. They may not, under any circumstances, relate to the subject or consistency of the contract. 2 –The negotiation commission is made up of the president, his deputy and two representatives from the project owner's organisation, appointed by the president. The commission may call on any person, expert or technician it deems useful to contribute to its work. When the negotiation commission decides to consult an expert or a technician, the president of the commission asks the project owner to invite the expert and/or technician concerned to take part in the work of the commission. 3 –Negotiated contracts are awarded with prior publicity and competitive tendering or without prior publicity and competitive tendering. Negotiated contracts with prior publicity and competitive tendering are awarded in accordance with the provisions of article 88 of this decree. With the exception of the cases provided for in subparagraphs 7 and 9 of paragraph II) of Article 89 below, negotiated contracts without prior publicity and competitive tendering are awarded after negotiation of the terms of the contract by the negotiation commission with the competitor or competitors consulted. The negotiations shall be the subject of the report referred to in paragraph 9 of Article 88 below. 4 –Any candidate for a negotiated contract must provide, at the beginning of the procedure, an administrative file and a technical file comprising all the documents provided for in article 28 of this decree. 5 –With the exception of the case referred to in subparagraph 2 of paragraph II) of Article 89 below, the award of a negotiated contract shall give rise to the drawing up, by the project owner, of an administrative certificate relating to the head of exception justifying the use of the negotiated procedure and explaining, in particular, the reasons for the choice of this procedure. 6 –The competent authority may, by motivated decision, terminate the negotiated procedure at any time. The decision to cancel the negotiated procedure without prior publicity and competitive tendering is placed in the contract file.
