Article 18 : Appel à manifestation d’intérêt

L’appel à manifestation d’intérêt a pour objet de permettre au maître d’ouvrage d’identifier, préalablement au lancement de l’appel à la concurrence, les concurrents potentiels. L’appel à manifestation d’intérêt fait l’objet d’un avis publié dans un journal à diffusion nationale au moins et sur le portail des marchés publics pendant un délai fixé par le maître d’ouvrage. L’avis d’appel à manifestation d’intérêt fait connaître notamment : –– l’objet de la prestation à réaliser ; –– les pièces à produire par les concurrents ; –– le lieu de retrait des dossiers ; –– le lieu de réception des candidatures ; –– la date limite de la réception des candidatures. L’appel à manifestation d’intérêt ne peut avoir pour effet de limiter le nombre des concurrents. L’appel à manifestation d’intérêt n’ouvre aucun droit aux concurrents potentiels et ne justifie pas le recours à la procédure négociée, ni à l’appel d’offres restreint, à moins que les conditions de recours à ces procédures ne soient remplies.

The purpose of the call for expressions of interest is to enable the project owner to identify potential competitors prior to launching the call for competition. The call for expressions of interest is the subject of a notice published in at least one nationally circulated newspaper and on the public procurement portal for a period fixed by the project owner Decree on public procurement-No. 2-22-431-8 March 2023 21 The notice of call for expressions of interest shall specify in particular: –the subject of the service to be provided; –the documents to be produced by competitors ; –the place where the file can be removed; –the place where applications may be received; –the deadline for receipt of applications. The call for expressions of interest may not have the effect of limiting the number of competitors. The call for expressions of interest does not confer any rights to potential competitors and does not justify recourse to the negotiated procedure or the restricted invitation to tender, unless the conditions for recourse to these procedures are met.
