Article 130 : Procès–verbal du concours architectural

Le jury du concours architectural dresse, séance tenante, procès–verbal de chacune de ses réunions. Ce procès–verbal, qui n’est ni rendu public ni communiqué aux architectes, mentionne le budget prévisionnel maximum prévu pour l’exécution du projet, fait état, le cas échéant, des observations formulées par les membres du jury au cours des opérations d’examen des offres et fait connaître le point de vue du jury sur ces observations. Le procès–verbal indique, également, les motifs d’élimination des architectes évincés, les éléments précis sur lesquels le jury s’est fondé pour déterminer l’offre qu’il juge la plus avantageuse à proposer au maître d’ouvrage sur la base des critères figurant au règlement du concours architectural. Ce procès–verbal est signé, séance tenante, par le président et par les membres du jury. Il est joint au procès–verbal de la séance d’examen des offres, le cas échéant, tout rapport établi et signé, sous leur responsabilité, par les membres de la sous–commission ou l’expert. Un extrait du procès–verbal est publié sur le portail des marchés publics et affiché dans les locaux de l'organisme dont relève le maître d’ouvrage dans les vingt–quatre heures qui suivent la date d’achèvement des travaux du jury. La durée d’affichage de cet extrait est de quinze jours au moins.
Official English translation

The architectural competition jury draws up, immediately, minutes of each of its meetings. These minutes, which are neither made public nor communicated to the architects, shall mention the maximum estimated budget for the implementation of the project, the observations made, if any, by the members of the jury during the tender examination process and state the point of view of the jury on these observations. Decree on public procurement-No. 2-22-431-8 March 2023 113 The minutes shall also state the reasons for excluding the excluded architects and the precise elements on which the jury based its decision to select the tender, it judges to be the most advantageous to be submitted to the project owner, in the light of the criteria set out in the architectural competition rules. The minutes are immediately signed by the president and the members of the jury. Any report drawn up and signed, under their responsibility, by the members of the sub- commission or the expert is attached to the minutes of the tender examination session, if applicable. An extract from the minutes is published on the public procurement portal and posted within the premises of the project owner's organisation within twenty-four hours following the date of completion of the jury's work. This extract must be posted for at least fifteen days.
