Article 103 : Contenu des dossiers des architectes

Les dossiers présentés par les architectes comprennent: I) Le dossier administratif qui comprend: A. Pour chaque architecte concurrent au moment de la présentation des offres: 1 – la déclaration sur l’honneur ; 2 – un extrait des statuts de la société d’architectes et/ou le procès–verbal de l’organe compétent conférant à l’architecte le pouvoir d’engager cette société à l’égard des tiers ; 3 – une copie certifiée conforme à l’original de l’autorisation d’exercice de la profession d’architecte délivrée par l’administration compétente ; 4 – l’attestation d’inscription au tableau de l’Ordre national des architectes délivrée depuis moins d’un an ou sa copie certifiée conforme à l'original ; 5 – les pièces justificatives de la nationalité de l’architecte ou des dirigeants de la société d’architectes, selon le cas, pour les contrats passés pour les besoins de la défense nationale ou de la sécurité publique ; 6 – l’attestation de présence à la réunion ou à la visite des lieux, lorsque cette présence est obligatoire. B. Pour l’architecte concurrent auquel il est envisagé d’attribuer le contrat et les architectes bénéficiaires des primes: 1 – une attestation ou sa copie certifiée conforme à l’original délivrée depuis moins d’un an par le percepteur du lieu d’imposition certifiant que l’architecte est en situation fiscale régulière ou, à défaut, qu’il a constitué les garanties jugées suffisantes par le comptable chargé du recouvrement conformément à la législation en vigueur en matière de recouvrement des créances publiques. 2 – une attestation ou sa copie certifiée conforme à l’original délivrée depuis moins d’un an par la caisse nationale de sécurité sociale certifiant que l’architecte est en situation régulière envers cet organisme. II) La proposition technique qui doit contenir: 1 – Une note de présentation comportant: a) le parti architectural du projet par rapport aux critères fixés par le règlement de consultation architecturale ; b) la consistance du projet par rapport au programme de la consultation architecturale ; c) une note descriptive des matériaux utilisés. 2 – Une esquisse sommaire du projet ; 3 – Le calendrier d’établissement des études ; 4 – Une estimation sommaire, hors taxes, du coût global des travaux basée sur les ratios de surfaces du projet. III) La proposition financière comprenant l’acte d’engagement précisant la proposition d’honoraires. Cet acte d’engagement, signé par l’architecte concurrent ou son représentant habilité, doit comporter l’ensemble des indications requises y compris le relevé d’identité bancaire (RIB).

The files submitted by architects shall include : I) the administrative file which includes: A. For each competing architect at the time of submission of tenders: 1 –The declaration of honor; 2 –An extract from the company statutes of the architectural firm and/or the minutes of the competent body conferring on the architect the power to bind the firm with regard to third parties; 3 –A certified copy of the original authorisation to practice the profession of architect issued by the competent authority; 4 –A certificate of registration on the roll of the National Order of Architects issued less than one year ago or a certified copy of the original. 5 –Supporting documents of the nationality of the architect or the directors of the architectural firm in the case of contracts awarded for national defence or public security purposes; 6 –Certificate of attendance at the meeting or site visit, when attendance is compulsory. B. For the competing architect to whom it is intended to award the contract and for the architects who will receive premiums: 1 –A certificate or a certified copy of the original certificate issued less than one year by the tax collector of the place of taxation, certifying that the architect is in a regular tax situation or, in the absence of payment that he has provided the guarantees deemed sufficient by the accountant responsible for collection, in accordance with the legislation in force on the collection of public debts; 2 –A certificate or a certified copy of the original certificate issued less than one year by the National Social Security Fund certifying that the architect is in a regular tax situation with this body. II) The technical proposal, which must contain : 1 –A presentation note including: a) The architectural part of the project in relation to the criteria set out in the architectural consultation regulations; b) The consistency of the project in relation to the architectural consultation programme; c) A descriptive note of the materials used. 2 –A summary outline of the project; 3 –The timetable for preparing the studies; 4 –A rough estimate, excluding taxes, of the overall cost of the works based on the project's surface area ratios. III) The financial proposal including the act of commitment specifying the proposed fees. Decree on public procurement-No. 2-22-431-8 March 2023 96 This act of commitment, signed by the competing architect or his authorised representative, must include all the required information, including bank identity statement.
