Décret n° 2-22-431 du 15 chaabane 1444 (8 mars 2023) relatif aux marchés publics

Article 1 : Principes généraux

La passation des marchés publics obéit aux principes suivants : –– la liberté d’accès aux marchés publics ; –– l’égalité de traitement des concurrents ; –– la garantie des droits des concurrents ; –– la transparence dans les choix du maître d’ouvrage. La passation des marchés publics obéit, également, au principe d’intégrité et aux principes de bonne gouvernance. Le maître d’ouvrage prend en compte, lors de la passation des marchés publics, selon le cas, les dimensions économique, sociale, environnementale et écologique, les objectifs du développement durable, l’efficacité énergétique, la préservation des ressources hydriques, la valorisation du paysage architectural, la sauvegarde du patrimoine national et des monuments historiques et les exigences liées à la promotion de l’innovation et de la recherche et développement. Les principes et les exigences prévus par le présent article concourent à assurer l’efficacité des marchés publics et la bonne utilisation des deniers publics. Ils exigent une définition préalable des besoins, le respect des obligations de publicité et de mise en concurrence et le choix de l’offre économiquement la plus avantageuse. Ces principes et exigences sont mis en œuvre conformément aux règles prévues au présent décret.

General principles Public procurement is governed by the following principles: –Freedom of access to public contracts; –Equal treatment of competitors; –The guarantee of competitors' rights; –Transparency in the choices made by the project owner. Public procurement also obeys the principles of integrity and good governance. When awarding public contracts, the project owner takes into account, as appropriate, the economic, social, environmental and ecological dimensions, the goals of sustainable development, energy efficiency, the preservation of water resources, the enhancement of the architectural landscape, the safeguarding of the national heritage and historical monuments and the requirements linked to the promotion of innovation and research and development. The principles and requirements set out in this article contribute to ensuring the effectiveness of public procurement and the proper use of public funds. They require a prior definition of needs, compliance with advertising and competitive tendering obligations and the choice of the most economically advantageous tender.
